After the hearing, we will immediately draft a detailed summary of the hearing and make recommendations to the claims adjuster on further litigation action.

The Texas Labor Code and DWC Rules contain numerous provisions protecting carriers from overpayments due to decisions, orders or medical opinions that are later overturned or modified by final decision or order. If you have made an unrecoupable overpayment, our law firm will request reimbursement from the Subsequent Injury Fund (SIF). Once we send the reimbursement request, we will continually monitor for the receipt of the refund from the SIF.

Our law firm can represent your interests if a complaint is filed against the carrier. An injured employee, doctor, or other party may file a complaint against you, or you may want to file a complaint against another party. Our law firm has handled numerous complaint matters for our clients before the Division. The Division of Workers’ Compensation system is, in part, a complaint-driven system, and Division scrutiny is partly directed by the performance-based oversight (PBO) laws. The Division will target insurers that are “poor performers” under the PBO system. Our law firm has successfully handled responses throughout the complaint resolution process.
